Signing Requirements

In Arizona, one adult witness or a notary public should sign the advance directive.[1] The witness must be at least 18 years old and must not be[2]:

  • Related to the principal.
  • The selected health care agent.
  • Participating in the principal’s health care when they sign the advance directive.
  • Entitled to any of the principal’s estate.

Revocation

In most cases, the principal may revoke the advance directive by[3]:

  • Executing a new one.
  • Written revocation.
  • Notifying the agent or health care provider orally.
  • Any manner displaying the intent to revoke the document or remove the powers of the agent.

For the mental health care power of attorney section, the principal must be capable of giving informed consent to be able to carry out the revocation.[4]

Registering

Though not mandatory, Arizona offers a free service to rescind advance directives called the Arizona Healthcare Directives Registry (AzHDR). This safeguards the document and allows it to be easily accessible when needed.

To register, the principal must carry out the following steps[5]:

  1. Fill out and sign the registration agreement
  2. Email a copy of the registration agreement and the advance directive to documents@azhdr.org. The documents may also be mailed to:

  3. When the documents are verified, the principal receives a letter from the AzHDR with login information. Follow the instructions to register the account.
  4. Verify the online documents and make any updates as needed.
