Signing Requirements

The principal must have their signature acknowledged by a notary public and one witness. The following individuals cannot act as a witness[1]:

  • The principal’s physician or mental health provider
  • The owner of the principal’s health care facility or the owner’s relative
  • The principal’s or agent’s parent, sibling, or descendant or that of their spouse (by blood, marriage, or adoption)
  • An agent or successor agent for property
