If the principal wants their general power of attorney to terminate upon their incapacitation, they must indicate this intention in the special instructions portion of the document. Otherwise, the agent’s powers will continue even if the principal cannot make decisions for themselves.[1]
The principal should sign the power of attorney in the presence of a notary public.[2]
