A New York advance directive must be signed by two witnesses.[1]
The person named as health care proxy cannot act as a witness.
The principal can revoke their advance directive by issuing an oral or written revocation, or by executing a subsequent directive to replace the original.[2]
If the health care agent is the principal’s spouse, their appointment is revoked in the event of divorce or legal separation.
