Signing Requirements
A psychiatric assessment of the declarant is required, and at least two witnesses must sign an advance directive.[1]
Individuals prohibited from witnessing include the declarant’s physician, provider, relative, or the facility owner where the principal is a patient.[2]
Revocation
If the individual is still capable, they may revoke the advance directive by communicating their wishes to their healthcare provider, who will note the revocation on their record.[3]
Regardless of mental capacity, the principal may revoke the document by defacing, burning, or destroying it or by submitting a written revocation that they have signed and dated.[4]
Registering
Any resident with a completed Living Will may register the document with the Secretary of State by mailing the completed form and filing fee to[5]:
