Signing Requirements
North Dakota advance directives require the signatures of two witnesses or a notary public to be legally valid.[1]
At least one witness cannot be providing health/long-term care to the principal.
The witnesses/notary public cannot be any of the following:
- The principal’s agent.
- The principal’s spouse or heir.
- Related to the principal by blood, marriage, or adoption.
- Entitled to the principal’s estate.
Advance Directive (Preview)
Revocation
An advance health care directive can be revoked by the principal doing either of the following[2]:
- Notifying the health care agent or health care provider of the revocation.
- Executing a new advance directive.
