Signing Requirements

The health care proxy must be executed in the presence of two adult witnesses, who must also sign.[1]

A health care agent named in the document cannot also serve as a witness.

Revocation

A health care proxy can be revoked by any of the following methods[2]:

  • Giving the health care provider or agent oral or written notice of the revocation.
  • Signing a subsequent health care proxy form.
  • The divorce or separation from a spouse who was named health care agent.

Because Massachusetts living wills are non-binding, they have no defined signing requirements.
