A Massachusetts advance directive is a two-part document that appoints a health care agent and relays a person’s wishes for their end-of-life medical care. The health care proxy portion appoints a representative while a personal directive (or “living will”) can be used to set out their beliefs, preferences, and instructions for the agent to follow.

Signing Requirements

The health care proxy must be executed in the presence of two adult witnesses, who must also sign.[1]

A health care agent named in the document cannot also serve as a witness.

Revocation

A health care proxy can be revoked by any of the following methods[2]:

  • Giving the health care provider or agent oral or written notice of the revocation.
  • Signing a subsequent health care proxy form.
  • The divorce or separation from a spouse who was named health care agent.

Because Massachusetts living wills are non-binding, they have no defined signing requirements.
