Breach of NDA
Breaching an NDA allows the injured party to pursue legal remedies. California law states that such action must be filed within four years of the contract breach.[1]
If the breach is due to the misappropriation of trade secrets, actions must be filed within three years from the date misappropriation is found.[2]
Trade Secret: Defined
In California, information is considered a trade secret if the owner[3]:
- Gains actual or potential economic value as a result of the information not being known by those who may also profit from it.
- Is protecting the information from being disclosed to unauthorized parties.
