Signing Requirements

The Statement of Consent: Issuance of a US Passport to a Child must be notarized. The date of the notary’s signature must match the date of the parent or guardian’s signature.

When to Use

Both Parents Have Custody, One Can’t Attend

If both parents or guardians have custody, the Statement of Consent Form DS-3035 must be filled out when one parent cannot attend the child’s application process in person.[1]

Neither Parent Can Appear in Person

If neither parent can accompany the child, and a third party, such as an aunt, uncle, or grandparent, will attend instead, each parent must fill out a separate form and include a photocopy of their ID.

Proof of sole custody must be provided to the third party if only one parent is completing this document.

If the Legal Guardian is a Private Institution or Office

If the minor child is in the care of a state or government agency or a private institution such as a foster care agency, a representative must be selected to apply on behalf of the child. In addition to the Statement of Consent form, the following must be included:

  • A statement from the private institution or office stating that the selected representative has the authority to apply on behalf of the child
  • A photocopy of the employee ID proving they work at the institution or agency
  • A certified copy of the court order granting guardianship to the office or institution

Other Documents to Bring to the Application

In addition to the consent form, the parent or guardian of the minor child must bring several documents to the application, including:
  1. DS-11 passport application – Filled out and printed.
  2. Child’s proof of citizenship (+ photocopy) – This could be a birth certificate, certificate of citizenship, passport, or a Consular Report of Birth Abroad or Certification of Birth.
  3. Proof of parent/guardian’s relationship – This proof could be in the form of a birth certificate, court order, or custody decree.
  4. Parent/guardian’s photo identification (+ photocopy).
  5. Child’s passport photo.

Photo Identification

The following are acceptable forms of photo identification to photocopy and submit along with the application[2]:

  • Valid driver’s license
  • Valid or expired passport book or card
  • Military ID
  • Permanent residence card
  • Matricular (Mexican) Consular ID
  • Government employee ID
  • Trusted Travelers ID
  • Enhanced Tribal Cards
  • Native American tribal photo ID
  • Certificate of Naturalization
  • Certificate of Citizenship
