How to Legally Change a Name in Maryland
Step 1 – Draft the Petition
To initiate the name change process, the petitioner must complete the Petition for Change of Name of an Adult (CC-DR-060).
A copy of an official document verifying the petitioner’s current legal name, such as a birth certificate, driver’s license, or passport, must be attached to the Petition.[1]
Step 2 – File With the Circuit Court
Both the Petition and the supporting identification document must be filed with the circuit court in the county where the petitioner resides, works, conducts business, or was born (see court locations).[2] Online filing is available in all Maryland jurisdictions except Baltimore City.
Step 3 – Pay the Filing Fee
Payment is due upon filing with the circuit court. Currently, the cost for a name change is $165. Individuals who can’t afford to file may be eligible for a fee waiver.
Step 4 – Wait 30 Days
After the petition is filed, the court must wait 30 days to allow for any objections before deciding on the request.[3] The court may also schedule a hearing to confirm the petitioner’s reasons or to address objections from other parties.
Step 5 – Receive Order
If approved, the court will issue an Order granting the name change. Certified copies may be purchased from the clerk’s office and are needed to update the petitioner’s identification records.
Marriage and Divorce
In Maryland, either spouse may assume the other’s last name during marriage. A couple can also use a hyphenated combination of both surnames or choose a new name altogether, provided the change is not for any unlawful purpose.[4] A certified marriage certificate serves as proof of the new name when updating IDs and records.
During divorce proceedings, either spouse may ask the court to restore a previous name by including the request in the divorce filings. Alternatively, a Motion for Restoration of Former Name (CC-DR-097) may be filed within 18 months after the divorce decree is issued.
