Eligibility Requirements

  • Must be 18 years old or older
  • Must be a resident of the county where the petition is filed
  • Minors must have the petition authorized by both parents (or guardians)
  • Cannot have a first or second-degree murder conviction
  • Cannot be a convicted sex offender

How to Legally Change a Name in Tennessee

Step 1 – Gather Documents

The petitioner must complete the Petition for Change of Name and Order for Name Change of Adult, and have the Petition notarized.[1] Some courts may require that their county-specific form be used. The petitioner must also gather the following documents:

  • Birth certificate
  • Social security card
  • Proof of residency
  • Proof of ID
  • Passport (required in some counties)
  • Marriage certificate/divorce decree (required in some counties)

Step 2 – File Petition

The petitioner must verify which court handles name change filings in their county of residence and bring the above documents there (either the chancery, circuit, or probate court).[2] A filing fee will be charged, and the petitioner will be given a hearing date.[3]

Step 3 – Obtain Name Change

The petitioner must attend their hearing, and the judge will review their case. If the judge approves the name change request, they will sign the Order, and the petitioner’s name will be legally changed.[4] The court hearing may take place in person or online.

Marriage and Divorce

Name changes for marriage or divorce do not require court involvement. A person may change their surname on a marriage certificate or return to their former one through a divorce decree. Official records can be updated by submitting either form to the applicable government office.
