Breach of NDA

Breaching an NDA can result in litigation. In Connecticut, the party filing a lawsuit must do so within six years of the NDA violation.[1]

That said, parties filing a lawsuit for trade secret misappropriation only have three years from the date of discovery to file.[2]

Connecticut law requires that both requirements be met for information to qualify as a trade secret[3]:

  • The information has independent economic value due to it not being generally known or reasonably ascertainable.
  • The information is being protected by reasonable security measures.
