Breach of NDA

Parties that breach their NDA may be liable for damages. Indiana law permits up to ten years following a contract breach for the injured party to take legal action.[1]

Legal action for the misappropriation of trade secrets must be brought within three years of its discovery.[2]

  • Could be or does create independent economic value due to its secrecy.
  • Is subject to efforts to maintain its confidentiality.
