Breach of NDA
Failing to uphold an NDA can have legal ramifications. In Louisiana, parties have up to three years from the date that misappropriation is discovered to seek damages.[1]
Trade Secret: Defined
Under Louisiana law, information that meets the below criteria is considered a trade secret[2]:
- The owner benefits financially from the information, due to it not being public and readily replicable.
- The owner is taking measures to prevent the information disclosure to unauthorized parties.
