An action for breach of NDA must be brought within six years of discovery of the breach.[1]
For misappropriation claims, the injured party will have three years from the date of discovery (or from when it should have been discovered with due diligence) to bring an action against the offending party.[2]
Any information that has economic value because it is not known or easily ascertainable and is kept secret by its owner qualifies as a trade secret.[3]
