Breach of NDA
Washington has a six-year statute of limitations for legal action arising from a breach of a written agreement, including NDAs.[1]
Trade secret misappropriation lawsuits must be filed no later than three years from when misappropriation was ascertained.[2] If, through reasonable due diligence, misappropriation should have been uncovered sooner, the statute of limitations begins at that date instead.
Trade Secret: Defined
To qualify as a trade secret, the information must be kept secret by its owner, have independent economic value, and not be generally known or readily ascertainable by third parties.[3]
