An Idaho general power of attorney is a document that allows an individual (the agent) to make legal decisions on another’s behalf (the principal). The document will specify the powers that will be entrusted to the agent, such as financial transactions or buying and selling property.

Unlike a durable power of attorney, a general power of attorney is only valid as long as the agent is mentally sound, meaning the document is void once the agent becomes incapacitated. The principal will need to use the special instructions section on page five (5) to indicate that the general power of attorney expires upon their incapacitation. The completed form requires notary acknowledgment to be deemed legally valid.

Durable Power of Attorney – A durable power of attorney is used to entrust an agent to make financial decisions on behalf of the principal, and it remains intact in the event that the principal is no longer capable of making decisions.
