The Texas property disclosure statement (Form OP-H) provides real estate buyers with a description and inventory of a property for sale and its condition. In addition to describing the residence’s utilities and fixtures, the seller must disclose any known property damage, infestations, health hazards, and whether the property is located in a flood plain.

State law requires the seller of any single-family residence to complete this disclosure and provide it to the buyer on or before the date that a purchase agreement is signed. However, the seller is not legally required to fill out a property disclosure if the residence is part of a multi-family dwelling (condo, townhouse, or apartment).
