A North Carolina notary acknowledgment is a form attached to a legal document that validates the signatures therein. By signing this acknowledgment, the notary public states that the signing party has proved their identity and they are signing the document without coercion. The notarial form will include the name of the signatory, and the seal, signature, and commission expiry date of the notarial officer.
In North Carolina, a notary public’s commission must be renewed every five years (§ 10B-9).
Is Online Notarization Legal in North Carolina?
Yes, House Bill 776 permanently allows remote online notarization in North Carolina. The form for an electronic notarization must include the following:
- The name of the notary and the state and county where they perform notarial acts,
- The words “Electronic Notary Public” and “State of North Carolina,”
- The commission expiration date,
- The electronic signature of the notary; and
- The finished text of one of the following notarial certificates: Acknowledgment, Jurat, Verification or Proof, Oath or Affirmation.
