Signing Requirements
At least one witness or a notary public must witness the principal’s signature.[1] Neither can be related to the principal, the agent, entitled to the principal’s estate, or involved in their health care.
Legal Definition
“Health care power of attorney” means a written designation of an agent to make health care decisions that meets the requirements of section 36-3221 and that comes into effect and is durable as provided in section 36-3223, subsection A.[2]
Revocation
An agent’s authority can be revoked by written statement, a new power of attorney, notifying the representative or a health care provider, or by any other manner that communicates an intent to revoke.[3]
