Signing Requirements

Notary acknowledgment and the signature of at least one witness are required on the power of attorney. The witness may not be[1]:

  • The attending physician or mental service provider.
  • The agent or successor agent.
  • Anyone who owns or runs a healthcare facility where the principal lives or receives treatment.
  • A relative of the principal or a relative of any party mentioned above.
