Signing Requirements

For the power of attorney to be valid, the principal’s signature must be[1]:

  • Acknowledged before a notary public
  • Witnessed by two individuals who aren’t designated as agents or recipients of gifts in the power of attorney (the notary public can serve as a witness)

Additionally, the agent must sign the power of attorney and acknowledge their signature in front of a notary public.[2]
