Signing Requirements

The principal’s signature must be acknowledged or proved by one of the following officers if the agent has the power to convey, release, or lease property[1]:

  • A judge, clerk, or deputy of a court of record
  • A clerk/recorder of any county or their deputy
  • A notary public

Recording

If the attorney-in-fact has the power to transfer property, the power of attorney document must be recorded in the same office where the conveyances themselves would be.[2]
