Legal Definition

“Durable power of attorney for health care,” an instrument executed pursuant to § 59-7-2.1 that authorizes its attorney in fact to make a health care decision or to consent to health care on behalf its principal.[2]

Revocation

South Dakota laws do not specify procedures for revoking a medical power of attorney. Typically, the principal can revoke the document by creating a new one or by informing their health care provider and agent that they want to revoke it.
