A Hawaii property disclosure statement is used by home sellers to report to buyers any material defects, past and present, that could affect the value of the real estate for sale. The disclosure identifies damages that are actually known to the seller and which can be readily observed. Such damages can include pest infestations, contaminated soil, plumbing issues, and structural deficiencies. There may exist defects of which the seller is unaware. For this reason, prospective buyers should obtain expert advice to evaluate the home’s condition. The completed disclosure statement must be delivered to the buyer no later than ten (10) calendar days after the acceptance of a purchase offer.
