Signing Requirements

An advance directive requires the signatures of two witnesses or a notary public.[1]

The following persons may not act as a witness:

  • A healthcare provider or their employee
  • The attorney-in-fact (agent)
  • The operator of a residential or community care facility or their employee

Revocation

An advance directive can be revoked by the principal if they are not incapacitated.[2]

A revocation may be done in any manner that expresses an intent to revoke, such as by a signed document or orally. Oral revocations must be recorded promptly in a written statement signed and dated by the principal or a witness of the revocation.
