Signing Requirements

For a Maryland advance directive to be valid, it must be signed by two witnesses in the principal’s physical or electronic presence.[1]

The principal’s health care agent cannot be a witness, and one witness must not be an individual who is entitled to the principal’s estate or will benefit from their death.

Revocation

An advance directive can be revoked through any of the following methods[2]:

  • A signed and dated written revocation.
  • Physically destroying the original document.
  • Making an oral statement to a health care practitioner.
  • Making and signing a new advance directive.
