Florida lady bird deed is an estate planning instrument that provides property owners with a means of passing on real estate to family or friends upon their death. Also known as an enhanced life estate deed, it allows the owner to do as they please with their property during their lifetime. After their death, the beneficiaries receive the property out of probate.

Signing Requirements

The deed must be signed by the grantor and two witnesses. All signatures must be acknowledged before a notary public.[1]

Recording

Where to Record

Deeds are to be recorded with the Circuit Court clerk in the county where the property is located.[2] The recording fee is $10 for the first page and $8.50 per additional page at the time of writing.[3]

Formatting

  • The top corner of the first page must have a 3″ x 3″ margin.
  • The top right corner of all other pages must have a 1″ x 3″ margin.[4]
  • Documents should not be larger than 8.5” x 14”.[5]
