Breach of NDA

Under Maine law, a party may only take legal action within six years from the date that an NDA breach is found.[1]

For breaches involving trade secrets, legal action must be brought within four years of discovering the misappropriation.[2]

Trade Secret: Defined

To qualify as a trade secret under Maine law, the information must meet the following criteria[3]:

  • The information holds economic value by not being widely known or easily obtainable.
  • The information owner is protecting its confidentiality.
