Breach of NDA

Minnesota plaintiffs have six years following a contract breach to file a lawsuit.[1]

For cases of trade secret misappropriation, lawsuits must be filed within three years from the discovery of misappropriation.[2]

Trade Secret: Defined

Information meets Minnesota’s statutory definition of a “trade secret” if[3]:

  • It can independently create economic value by being kept confidential.
  • It is not easily obtained by competitors.
  • Its secrecy is protected by the owner.
