Breach of NDA

The statute of limitations for bringing legal action for breach of an NDA is three years from the date the breach is discovered.[1]

If the breach was a misappropriation of trade secrets, the same three-year timeline applies.[2] The deadline is set based on when the misappropriation was discovered or should have been discovered with proper due diligence.
