Breach of NDA
The statute of limitations for bringing legal action for breach of an NDA is three years from the date the breach is discovered.[1]
If the breach was a misappropriation of trade secrets, the same three-year timeline applies.[2] The deadline is set based on when the misappropriation was discovered or should have been discovered with proper due diligence.
Trade Secret: Defined
Information that is subject to efforts to keep it a secret, derives independent economic value, and would decrease in value if disclosed to the public or a competitor qualifies as a trade secret.[3]
