An Illinois general power of attorney is a legal document used by an individual (the principal) to give a third party (the agent) control and responsibility over their affairs, allowing them to act on the principal’s behalf. This document can apply to all financial, business, or property-related activities, and the exact scope of the agent’s power can be specified by the principal. A general power of attorney remains valid until it is revoked via written revocation document, the termination date is reached, or upon the incapacitation of the principal.

Signing Requirements (755 ILCS 45/3-3(b)) – Notary Public and One (1) Witness

Durable Power of Attorney – A durable power of attorney is used by a principal to grant an agent legal powers that remain in place even in the event of the principal’s incapacitation.
