The South Dakota motor vehicle power of attorney (Form 1023) authorizes a representative to act on behalf of a vehicle or boat owner and handle transactions with the Motor Vehicle Division. The representative is identified in the document as the “attorney,” although this individual does not actually have to be a lawyer. With their authority, the attorney can apply for a title in the owner’s name, or transfer a certificate of title to another party. A second representative may be designated if necessary, in which case the owner must state whether the attorneys may or may not work separately from each other when exercising their authority.
