Protection Limitations
A parental release form provides legal protection when a child is unintentionally injured. However, if a parent can prove they weren’t fully informed of the risks or that there was a blatant disregard for the safety and well-being of others, the release form may be considered unenforceable.
Understanding the Role of a Parental Release Form
Whether a child is participating in a track and field event, outdoor excursion, or any other activity that carries a risk of injury, a parental release form should be used to protect the activity provider from liability. The purpose of the form is to provide legal protection by:
- Describing the Activity – The document clarifies the activities being provided and informs parents of the potential dangers.
- Acknowledging Risks – It requires parents to confirm that they understand the risks and will assume responsibility for any issues that may occur.
- Documenting Consent – The release form serves as evidence that the parent has willingly permitted their child to participate in the event or activity.
- Waiving Liability – The form contains a release of liability waiver in which the parent agrees not to hold the organization, its staff, or volunteers accountable if the child gets injured while participating in the activity.
