Privacy
All people, including minors, are entitled to their right of publicity, which is why photographers must obtain consent from a child’s parent when photos are used commercially. However, images of children (and people) in public settings can typically be used without consent for the purposes of social media and other editorial purposes.
What’s IncludedPurposeA minor photo release form generally encompasses all commercial purposes, including promotion, publicity, and advertising. The child’s likeness can be used for audio-visual, electronic, print, and all other media formats. ReleaseBy signing a release, the parents acknowledge that the photographer or entity using the images has complete ownership over them. They have the right to apply them to any commercial medium, as long as it’s legal, without further permission from the parent.
Liability WaiverAuthorizing the release means the parent waives all liability on the part of the other party and agrees not to file legal claims or demands against them.
ApprovalA photo release also states that the parent waives their right to review or approve the photos before they are used for their intended purposes.
CompensationSometimes, the right to use a child’s photo and likeness is given in exchange for a one-time payment or royalties.
