An Indiana sublease agreement is a legal document that contains the terms and conditions of a rental arrangement between the original tenant of a residential rental unit (“sublessor”) and the subtenant (“sublessee”) who is renting all or a portion of said unit. Subleasing is not covered by Indiana statutes, so all sublessors should ask their landlord if it is permitted before renting out any part of their dwelling to a sublessee.

The sublessee is liable to the sublessor for the rent and other payments as well as the condition of the premises. However, the sublessor remains liable to the landlord for the same obligations. All provisions in the sublease agreement must not contradict or interfere with the original lease.
