Signing Requirements

Advance directives must be acknowledged by a notary or signed by two adult witnesses.[1]

Witnesses may not be the principal’s healthcare provider or agent.

Advance Directive (Preview)

Revocation

Advance directives that withhold life-sustaining treatment or artificial nutrition and hydration can be revoked in any way by the principal, regardless of competency.[2] Otherwise, a capable principal may revoke an advance directive by any means. Revocation becomes effective once a health care provider or agent is notified.

If the principal’s spouse has been appointed as an agent, their authority becomes suspended upon the filing of a petition for dissolution or annulment of marriage.
