Signing Requirements
Advance directives must be acknowledged by a notary or signed by two adult witnesses.[1]
Furthermore, witnesses may not be the principal’s healthcare provider or agent.
Revocation
Advance directives addressing life-sustaining treatments or artificial nutrition and hydration can be revoked in any way, so long as the principal can express the revocation.[2] Otherwise, a capable principal may revoke an advance directive by any means. The healthcare provider or agent must be notified of the revocation.
If the principal’s spouse has been appointed as an agent, their authority becomes suspended upon the filing of a petition for dissolution or annulment of marriage.
