The New York 1-month notice to quit can be used by landlords to terminate month-to-month lease agreements, giving the tenants one (1) month’s advance notice. Tenants must move out by the end of the notice period or face legal action. No justification is required to cancel a monthly lease as long as the appropriate notice is given.
When a landlord serves this document, they must do so in-person, giving the document directly to the tenant, or post it on the premises, in which case they must also send it by mail. Upon completing service, the landlord will need to complete an Affidavit of Personal Service or Affidavit of Substituted or Conspicuous Place Service which will be required to begin legal action if the tenant does not move out by the time the notice expires.
