A Nebraska notary acknowledgment is used to prove that a document was executed willingly by the individual who signed it. The form can only be used if the signer physically appears before a licensed notary to acknowledge (i.e., officially declare) that their signature was written freely for the purposes expressed in the document. Unless personally known by the notary, the signer must prove their identity with either a government-issued ID or through the oath or affirmation of a witness.
An individual appointed as a notary public will serve a 4-year term starting from the date their commission becomes effective (§ 64-101(9)).
Is Online Notarization Legal in Nebraska?
Yes. Online notarizations became legal in Nebraska through the passing of Legislative Bill 186, taking effect on July 1, 2020. The rules for online notarizations can be found in Neb. Rev. Stat. §§ 64-401 – 64-418.
Before notaries can perform notarizations online, they are required to:
- Take an online notarization course
- Pass a written exam
- Submit an online application (see instructions)
- Pay the registration fee (currently $50)
Certificate of Authority – Some states and nations will require proof that the online notarization is authentic, in which case a Certificate of Authority for an Online Notarial Act must be completed by a Secretary of State official and attached to the online acknowledgment form (§ 64-4015).
