Chapter 93A

Chapter 93A is a set of laws titled “Regulation of Business Practices for Consumers’ Protection” that protect consumers from deceptive and unfair practices in commerce.

Before litigating a merchant under these laws, the consumer is required to send a demand letter giving them 30 days to respond and pay damages. If the recipient doesn’t respond, responds in bad faith, or makes an unreasonable offer, they may be liable for triple damages if the matter goes to court.

Relevant sections of the chapter include:

  • Section 2 – Declares unfair or deceptive trade and commerce unlawful.
  • Section 9 – States that a consumer who is a victim of unfair or deceptive trade and commerce can seek relief for injury and damages, and that they must send a demand letter 30 days before taking legal action.
  • Section 11 – Allows a business claimant who suffers loss of money or property due to unfair or deceptive acts or competition to sue the offender without a demand letter. However, the concerned activities must have taken place within Massachusetts.

How to Write a Demand Letter

A demand letter under Chapter 93A must include the following:
  1. The sender’s name and address.
  2. A description of the recipient’s unfair or deceptive actions.
  3. The sections of Chapter 93A that apply to the sender’s claim.
  4. A description of the sender’s injury or loss of property or money.
  5. A clear outline of the relief the sender seeks (usually monetary).
  6. A statement giving the recipient 30 days to respond to the letter.
  7. The sender’s signature.
