Montana power of attorney forms designate agents to represent a “principal” (individual assigning power). The agent, with the power of attorney signed, will have the authority to perform certain acts and make decisions on the principal’s behalf. The law demands that the agent act within the parameters of the power of attorney document and in accordance with the principal’s expectations. Furthermore, the principal can revoke, amend, or create a new power of attorney as they see fit. Depending on the type of arrangement, a notary acknowledgment may be required for a power of attorney to be valid.

Advance Directive – This form is used by the principal to relay their preferences regarding medical treatments and names a healthcare representative who becomes active if the principal is incapacitated.

Motor Vehicle (Form MV65) Power of Attorney – This document gives a representative the right to sell, purchase, title, and register a vehicle on behalf of the principal.

Minor (Child) Power of Attorney – The agent named in this form will be given temporary parental rights over a minor child. The form must be executed by the child’s legal parent or guardian.
