MONTH-TO-MONTH LEASE ADDENDUM

1. THE PARTIES. This Month-to-Month Addendum (“Addendum”), made effective as of [MM/DD/YYYY], is by and between:

Landlord: [LANDLORD’S NAME] (“Landlord”) and

 Tenant: [TENANT’S NAME] (“Tenant”).

The Landlord and Tenant are each referred to herein as a “Party” and, collectively, as the “Parties.”

2. ORIGINAL LEASE. This Addendum is being added to the lease agreement between the Parties, dated on [MM/DD/YYYY], for the property located at [RENTAL PROPERTY ADDRESS] (“Original Lease”).

3. TERMS. NOW THEREFORE, in consideration of the mutual covenants contained herein and other good and valuable consideration, the Landlord and Tenant agree as follows: (check all that apply)

– The Original Lease will be extended on a month-to-month basis after the expiration of the Original Lease term upon the same terms and conditions as contained in the Original Lease.

– The Landlord or Tenant may terminate the month-to-month tenancy by giving the other party written notice of termination at least [#] days prior to the next rent due date.

– During the month-to-month tenancy, the parties agree that total rent payable under the lease agreement shall be increased to $[RENT] per month beginning on [MM/DD/YYYY].

Except as specifically mentioned in this Addendum, all other terms and conditions of the Original Lease shall remain in full force and effect.

4. EXECUTION. This Addendum may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

Month-to-Month Addendum vs. Lease Extension

While month-to-month and lease extension addendums allow tenants to continue renting past the original lease termination date, there are differences between the two that should be considered before choosing.

Month-to-Month

  • Provides tenants flexibility as they can rent indefinitely
  • Allows landlords to charge higher rent as tenants are provided the convenience of a low-commitment tenancy
  • Can be terminated by the tenant or landlord without cause

Lease Extension

  • Generally keeps the same terms and rent as the original lease, except for the termination date
  • Ensures that the tenancy will continue for a fixed period (usually six (6) or twelve (12) months)

Frequently Asked Questions

Can a landlord raise the rent on a month-to-month addendum?

Yes. In most cases, landlords may increase a tenant’s rent when switching to a monthly rental term, provided the rent increase complies with the state and city’s rent increase laws and sufficient notice is provided (between 30 and 60 days for most states).

Can a landlord terminate a month-to-month addendum without cause?

Yes. Generally, a month-to-month tenancy may be terminated by written notice by either party. The amount of notice required may be specified in the addendum, though it must comply with the state’s required notice periods.
