Failure to Vacate
Arkansas is the only state that permits landlords to file criminal eviction actions against tenants. Also known as “failure to vacate,” this type of eviction can only be filed for non-payment violations.
The tenant could be convicted of a misdemeanor and may be fined up to $25 each day that they remain on the property after the 10-day notice period.[1]
