Massachusetts Quitclaim Deed Form

A Massachusetts quitclaim deed transfers ownership of a piece of real estate from a grantor to a grantee with limited assurances. These assurances, known uniquely in Massachusetts as “quitclaim covenants,” state the property title is free of encumbrances caused during the grantor’s ownership. However, they do not warrant against previous title defects.

Massachusetts Terminology – In most other states, a quitclaim deed functions slightly differently and offers zero guarantees that the title is clean or that the owner has rightful ownership. In Massachusetts, this is known as a “release deed.”

Signing Requirements – The grantor’s signature must be acknowledged by a justice of the peace or notary public.^[1]

Formatting Requirements

Deeds must follow the following formatting standards to be recorded^[3]:

Font: Sufficiently sized writing to be legibly reproduced on scanners
Ink: Sufficiently dark
Paper:
- No larger than 8.5×14 in.
- White
- Single-sided
Recording information area: 3” x 3” empty space in upper right corner of first page
