Mississippi power of attorney forms permit an individual (referred to as the “principal”) to appoint an agent who is given the power to sign documents and make decisions regarding finances, health care, minor children, or the transfer of property on the principal’s behalf. The scope of the authority is determined by the principal ’and can be adjusted to complete a single purpose, such as filing taxes or selling property, or grant general authorities to act on their behalf regarding finances or healthcare. After a power of attorney has been signed, the principal has the right to revoke and make a new power of attorney at any time.

Advance Directive – This document combines a living will and medical power of attorney. If the principal is incapacitated, the power of attorney comes into effect and the appointed agent will represent the principal in making medical decisions following instructions left in the living will.

Durable Power of Attorney – A durable power of attorney gives the attorney-in-fact the authority act on behalf of the principal even in the event of their physical and/or mental incapacity.

General (non-durable) Power of Attorney – This form is used to appoint an agent to make financial decisions on the principal’s behalf. Unlike the durable option, this power of attorney terminates upon the incapacitation of the principal.

Limited Power of Attorney – Grants the agent authority that is limited in comparison with the general power of attorney.

Motor Vehicle (Form 78-003-17-8-1-000) Power of Attorney – When an individual wishes to have a vehicle title transferred or registered on their behalf, they will need to use this form to give a third party the authority to do so.

Minor (Child) Power of Attorney – Parents of minor children must use this form to give another individual temporary parental authority.

Real Estate Power of Attorney – When an agent sells, purchases, or manages property on an individual’s behalf, they must use this form to obtain legal permission to act in that individual’s name.
